Terms and Conditions

You agree to the following terms and conditions when you rent a rack from Love Me, Love Me Not Preloved Clothing.

Definitions

“You” is the client.
“We”, “Us”, “Our” is Love Me, Love Me Not Preloved Clothing, its employees and and/or agents.

  1. Liability
    1. We take no liability for the authenticity of the clothes sold through our store.
    2. Whilst we make every effort to prevent theft by using security cameras, providing security tags and conducting regular bag checks, we accept no liability for lost or stolen items.
    3. We accept no liability for any damage caused to clothes whilst in our store, including damage resulting from customer handling, fire, water, acts of war, terrorism or any other acts of God.
  2. Rack Sizing
    1. You are required to adhere to the number of items that you can have on your rack, dependent on the size of the rack.
    2. Medium racks hold approximately 50 items of clothing and 5 pairs of shoes or handbags.
    3. Large racks hold approximately 70 items and 5 pairs of shoes or handbags.
    4. We reserve the right to remove any additional items on your stand, that exceed the maximum number of items that each rack holds.
    5. You cannot add any extra baskets or accessories to your rack.
    6. You are welcome to restock your rack as items sell, as often as you like, throughout the rental period, as long as the maximum number of items on the rack is not exceeded at any point within the rental period.
  3. Clothing
    1. You cannot sell counterfeit, stolen or damaged goods in our store.
    2. We reserve the right to remove any items from sale that we believe are counterfeit, stolen or damaged.
    3. We have built our trusted reputation by selling quality clean, fresh preloved clothing. We reserve the right to remove clothing items that are not of quality, nor clean and fresh.
    4. You will be contacted by an employee and/or agent of Love Me, Love Me Not Preloved Clothing should an incident under clauses 3.2 and 3.3 occur.
    5. For hygiene reasons, underwear and swimwear are deemed unsuitable for sale unless it is brand new with the original tags on.
    6. Due to the nature of our business, we do not accept returns / exchanges under any circumstances.
  4. Labelling
    1. If the label falls off your item, we are unable to sell it.
    2. All items with missing labels will be stored in a stock room for up to 14 working days.
    3. It is your responsibility to ask to check the stock room if you are missing any items from your rack.
  5. Booking Payments
    1. All payments must be made at the time of booking a rack.
    2. Your booking will be cancelled if payment is not received within 60 minutes making the
  6. Sales Payments
    1. For rack rentals, we will pay you the total of your sales less our 5% commission within 14 working days of the end of your rental agreement.
    2. For items in the display cabinet, we will pay you the total of your sales less our 30% commission within 14 working days of the end of your rental agreement.
    3. All payments will be made by bank transfer; we do not offer cash payments.
    4. We accept no liability and are not responsible for, payments not received by you because you entered the wrong bank account details on the rack hire agreement.
  7. Cancellation & Refunds Policy
    1. You may cancel your booking, in writing, up to 7 working days before the start of the rental period and receive a full refund by bank transfer, we do not offer cash payments.
    2. No refunds or credits will be offered for cancellations with less than 7 working days written notice.
    3. If you cancel your booking during the rental period, a refund will not be issued for the remaining days left of the rental period.
    4. If your rack sells out of all the items you have during the rental period and you are not going to fill it further a refund will not be issued for the remaining days left of the rental period.
  8. At The End Of Your Rental Period
    1. You must collect your items at the end of your rental period before 4.00pm on a weekday, and at or before 3.00pm on a Saturday.
    2. We do not extend our opening hours if you are running late to collect the items from your rack at the end of the rental period.
    3. If you fail to arrive at the store at least 30 minutes before closing time, you will be charged a $20 service charge for one of our employees and/or agents to pack up your clothes.
    4. If you do not show up to collect your clothes at the end of the rental period, one of our employees will pack clothing items. A $20 service fee will be deducted from the proceeds of your sales.
    5. Any clothing items packed up by one of our employees have to be collected within 14 working days from the end of your rental period.
    6. Any clothing items not collected after 14 working days will be donated to charity and/or become the store’s property and may be sold at the store’s discretion.
